The web site leguanahani.com (otherwise known as the “Site”), is published by Hotel Guanahani & SPA SAS (a French société par actions simplifiée) (hereafter “Guanahani”). Hotel Guanahani & SPA SAS is organized and existing under the laws of France and registered under n° RCS Basse Terre 332 773 613, with a share capital of EUR 27,941,022, with the Registre du Commerce et des Sociétés, whose registered office is located at Lieudit Marigot, Anse du Grand Cul-de-Sac, 97133 Saint Barthélémy, France. The publication director, and legal representative of the company, is Marc Stad, President.

The use of the Site is subject to the terms and conditions described below (hereafter the “Terms and Conditions”), whose purpose is to define the terms of access and use of the Site by any person (hereafter the “User”). Guanahani reserves the right to modify and update, at any time, the Terms and Conditions and/or the Content of the Site. When accessing the Site, Users shall be deemed to have accepted without reserve the Terms and Conditions and the Privacy Policy. The Terms and Conditions are governed by French law. To the extent permitted under applicable mandatory law, any and all disputes arising from the Content or the use of the Site shall be subject to the exclusive jurisdiction of French courts.

II. INTELLECTUAL PROPERTY

The Site and any content featured or displayed on the Site, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations, data, files, trademarks, designs and models, as well as any software used in connection with the Site (hereafter the “Content”) contain confidential information or information protected by existing intellectual property right legislation or any other law. Unless specified otherwise, intellectual property rights relating to such Content are the exclusive property of Guanahani. Guanahani does not grant any license or any other right except for the right to access and use the Site. The reproduction of all or any part of the Content is authorized solely for personal and private use. Any and all reproduction and use of copies of the Content for other purposes are explicitly forbidden. 1. Limitation of liability
Guanahani commits itself to ensuring, to the best of its ability, that the information posted on this Site is correct and up-to-date. Guanahani reserves the right to correct, at any time and without prior notice, the Content of the Site. However, Guanahani cannot guarantee the correctness, precision, thoroughness or completeness of the Content available on the Site and encourages Users to contact Guanahani directly. Guanahani does not control all risks related to the use of the Internet, and draws the User’s attention to the potential risks involved by the use of the Site. Guanahani shall not be held liable for: any Site interruptions; any bugs, display errors or error downloading the web pages of the Site; any errors or omissions contained in the Content available on the Site; any and all damage resulting from a third party’s fraudulent intrusion; or any direct or indirect damage, whatever its cause, nature, origins or consequences, resulting from the access to the Site or any Content coming directly or indirectly from the Site.

The Site may include links to other websites or other Internet sources. Guanahani cannot control these sites and external sources. Therefore, Guanahani shall not be held liable for those sites and external sources and declines any responsibility for the content, advertising, products, services and any other material available on or branching off those sites and external sources. In addition, Guanahani shall not be held liable for any damage or losses, true or alleged, deriving from the use or from having trusted the content, or goods and services available on those sites or external sources.

 

IV. PRIVACY POLICY

Guanahani committed to safeguarding your privacy while visiting its web site. Our goal is to provide you with an Internet experience that delivers the information, resources and services that are most relevant to you. To achieve this goal, part of the operation of the Site includes gathering certain types of information about Site users. Because we understand that your privacy is important, we wish to explain the types of information we collect and the ways in which this information is used. 1. What information is collected about me?
Guanahani collects and process Users’ personal data in conformity with French Law n°78-17 of 6 January 1978.
We may collect two types of information about you when you visit the Site, personal and non-personal (or aggregated) information. The term “personal information” refers to data you voluntarily provide in connection with the use of the Site that identifies you and/or the company on whose behalf you are accessing and using the Site. We may ask you for personal information when you request information from us, enter a contest or promotion sponsored by us, or when you report a problem with the Site. We may collect additional personal information in connection with online reservations. If you decide to make an online reservation, you will be linked to a separate interface. The reservation interface is designed and administered by third-party vendor and hosted by that vendor’s own hosting partner. Reservation data is handled by our vendor exclusively for the purpose of processing the transactions. In addition to being asked to provide the types of personal information discussed above, for purposes of making a reservation through the Site, you may be required to provide sensitive personal information, such as your mailing address, telephone number, email address and credit card information. When you make a reservation, your personal information goes into a central reservations database that can be accessed by our affiliates. Information collected as part of the reservation process is used as described in this Privacy Policy, whether or not you actually use the reservation. Guanahani cannot expressly warrant the operation of the reservation web site and/or matters relating to its security once you log on. Be sure to log off when you are done using the reservation site.

Guanahani may also collect non-personal information, or “aggregated data,” from you when you visit the Site. Guanahani considers the personal information collected on this Site to be confidential. We respect your right to control how your personal information is used. If, after consenting to our use of your personal information, you later decide that you no longer want Guanahani to include you on its mailing list, otherwise contact you, or use your personal information in the manners disclosed in this Privacy Policy or at the Site, simply tell us by sending an email to hotel@leguanahani.com.

If you have opted to receive communications from Guanahani, and need to change your information, such as your mailing address, email address, etc., you must unsubscribe and then register or submit your personal information anew.

4. What about cookies and web beacons?
To enable features at the Site, we may use cookies or web beacons on this web site, in emails or email advertisements, or in advertisements on other web sites. Cookies, among other things, speed navigation through our Site, keep track of information so that you do not have to re-enter it each time you visit our Site, help us provide you with customized content and allow us to learn about your visit. This Privacy Policy applies only to leguanahani.com. Guanahani may provide links to a number of other web sites that we believe might offer you useful information and services.
